Parliament Declares Kpandai Seat Vacant

The Parliamentary Service has officially informed the Electoral Commission (EC) of a vacant parliamentary seat in the Kpandai Constituency, paving the way for a re-run of the 2024 Parliamentary Election in the area as ordered by the High Court in Tamale.

The notification, dated December 4, 2025, signals the commencement of the administrative processes required for the EC to begin preparations for the fresh election. It follows a High Court ruling on November 24, 2025, which annulled the previous parliamentary results in Kpandai due to significant irregularities and legal inconsistencies.

The letter, addressed to the Chairperson of the EC, Mrs. Jean Mensa, was signed by the Clerk to Parliament, Mr. Ebenezer Ahumah Djietror. According to the Clerk, the action was taken “in exercise of the power conferred and the duty imposed on the Clerk to Parliament by Article 112(5), as amended, of the 1992 Constitution of the Republic of Ghana.”

In the letter, the Clerk formally notified the EC of the vacancy “occasioned by the Order of the High Court, Tamale, for a re-run of the Kpandai Parliamentary Elections,” referencing Suit Number NR/TL/HC/E13/22/25, in which the Clerk was listed as the 4th Respondent.

Under Article 112(5) of the Constitution, a by-election or in this case, a re-run must be held within 90 days after the vacancy occurs, unless it falls within three months before the dissolution of Parliament.

With the notification issued on December 4, the Electoral Commission is now constitutionally mandated to conduct the poll by early March 2026.

The directive is seen as a crucial step toward restoring full political representation for residents of the Kpandai Constituency, located in the Northern Region. The court’s decision has drawn keen national attention, highlighting the heightened political and legal scrutiny surrounding the aftermath of the 2024 general elections.

The upcoming re-run is expected to attract intense interest and investment from major political parties, given the potential implications for the balance of power in Parliament.

It also presents a renewed opportunity for the electorate in Kpandai to select their representative in a process expected to be closely monitored.

The Electoral Commission is anticipated to announce a detailed timetable in the coming weeks, including nomination procedures and the specific date for the re-run election.
