Private legal practitioner, Tanko Musah Zachariah, has urged the Office of the Special Prosecutor (OSP) to exercise its powers responsibly and in the best interest of the public.
While defending former Finance Minister Ken Ofori-Atta’s decision to invoke Article 14 of the Constitution, which guarantees personal liberty, he acknowledged the OSP’s mandate to investigate corruption-related matters.
However, he cautioned that such actions must align with national interest and respect due process.
“Exercising your power within institutions must always be done in the public interest,” Zachariah stated.
He questioned whether the OSP’s actions regarding the former minister were proportionate and justified in serving national interest.
Speaking on ABC in the morning, he emphasized that the court should be allowed to determine the case without external interference.
He also commended Ofori-Atta’s legal team for seeking judicial intervention, reiterating that judicial authority ultimately rests with the courts and discussions on the case should not prejudice the legal process.
