Alfred Kwabena Asiedu, the dismissed Jasikan Circuit Court judge, has initiated legal action against the Judicial Service subsequent to his removal by Chief Justice Her Ladyship Justice Gertrude Torkornoo.
Reacting to news of his dismissal, the former judge described the accusations against him as products of the petitioner’s misguided imagination.
Therefore, he is praying the court to declare his removal from office as ‘unlawful.’
The reliefs he’s seeking include: “A declaration that the removal of the Applicant from office as a Circuit Court judge as contained in the letter signed by the 2nd Respondent dated I3th November 2023 is unlawful.”
“A declaration that both the Disciplinary Committee and the Judicial Council acted ultra vires when they made a finding of malicious prosecution against the Applicant, and a declaration that the said findings of the two bodies are patent error of law on the face of record and same liable to be quashed by the supervisory powers of this Court.”
Background:
Earlier this week, the Jasikan Circuit Court judge, Alfred Kwabena Asiedu was dismissed by the Chief Justice, Her ladyship Gertrude Torkornoo, following a report by the disciplinary committee of the Judicial Council after a petition by one Singari Diana Sadia.
In the petition, the petitioner accused the judge of abuse of power, sexual exploitation, malicious prosecution and impropriety while he was hearing a divorce case involving her. The Judicial Council’s disciplinary committee’s investigation found that the judge was culpable of the accusations and recommended his dismissal.
Acting on this, the Chief Justice, in a letter, has directed him to handover all official property in his care to the Judicial Secretary and go home
