Constitutional Lawyer Kwame Adofo has firmly stated that the minority caucus’s attempt to invoke Article 97(1)(G) to remove four Members of Parliament is an exercise in futility. Adofo emphasized that the desired results sought by the minority will not materialize anytime soon.
He emphasized the complexity of Article 97(1)(G), which requires Supreme Court interpretation to resolve uncertainties about the conditions under which the Speaker can declare a seat vacant based on this provision.
Moreover, Adofo highlighted that a seat can only be declared vacant if the Speaker has credible evidence that a Member of Parliament has exited the political party through which they won their seat.
Speaking on ABC in the morning, he stressed the importance of formal notifications from the political parties of the four MPs to the Speaker of Parliament.
He noted that Speaker Alban Bagbin can only act upon receiving such evidence, as any decision he makes is subject to challenge in the High Court under Article 99 of the Constitution.
