The Attorney General, Godfred Dame who is the second defendant in the case has told Speaker Alban Bagbin to comply with the ruling; stressing he has no option.
His comment follows the ruling against Speaker of Parliament Alban Bagbin’s decision to declare four parliamentary seats vacant, siding with a challenge brought forward by Majority Leader Alexander Afenyo-Markin.
Addressing the media after the ruling, Lead counsel for the Afenyo Markin, Joe Ghartey argued that “The Supreme law is the constitution. Everybody else is under this constitution.”
“We expect every other Ghanaian to respect the law,” Joe Ghartey.
“Today democracy has won, constitutionalism has won,’ he added.
During today’s ruling, the seven-member panel, led by Chief Justice Gertrude Torkornoo, delivered a 5-2 majority decision in favour of Afenyo-Markin.
Chief Justice Torkornoo noted that a detailed explanation of the ruling will be provided later.
The dispute revolves around Speaker Bagbin’s interpretation of Article 97(1)(g) of the Ghanaian Constitution, which he cited as the basis for declaring the seats vacant.
“The plaintiff’s action succeeds. The full reasons and orders of the court shall be filled with the Register by the close of day tomorrow,” Justice Torkornoo said.
