Legal expert Yaw Dankwah has characterized the Supreme Court’s recent decision to dismiss the Speaker of Parliament’s application challenging its ruling as one which is well placed.
Dankwah praised the court’s ruling, emphasizing that it aligns with legal principles and the boundaries of the judiciary’s oversight.
“We saw checks and balances at work.”
“In their deliberation, I think they did soo well, in terms of the interpretation of the law, and the clarity they provided.”
“As a legal practitioner and academian, i will say that this was a legal gymnastics at work, which was perfect.
Speaker Bagbin’s application aimed to nullify the Supreme Court’s decision that temporarily halted his ruling on the four seats, arguing that the court had overreached by suspending his ruling, which he insisted was a parliamentary decision outside the judicial remit.
However, the Supreme Court dismissed the application, stating that the Speaker’s appeal was without merit. He spoke in an interview on ABC in the morning.
Meanwhile, Legal expert Yaw Dankwah explained that the decision by the Supreme Court to dismiss the objection to the empanelment of Justice Ernest Gaewu on the bench was due to insufficient evidence.
Lawyer for the Speaker, Thaddeus Sory contended that Justice Gaewu’s prior political ties posed a conflict of interest and therefore asked Justice Gaewu to recuse himself. However, this objection was dismissed by the Supreme Court as they argued that recusing a judge on such grounds will not advance the administration of justice.
