The High Court in Ho has dismissed a petition challenging the election of John Peter Amewu as the Member of Parliament for Hohoe, citing a lack of jurisdiction. The petition, filed by five residents from the Santrofi, Akpafu, Likpe, and Lolobi (SALL) enclave, sought to overturn Amewu’s victory in the 2020 parliamentary elections.
The SALL area, which consists of 13 communities, did not participate in the elections due to a dispute regarding their inclusion in the newly created Oti Region, which was carved out of the Volta Region.
In its ruling on Monday, the court determined that the petitioners’ challenge questioned the constitutionality of CI 128, the regulation that guided the Electoral Commission’s conduct during the 2020 elections. The court found that this issue fell outside its jurisdiction.
Amewu, who arrived late to the hearing, introduced three new issues that the National Democratic Congress (NDC) in the region described as a delay tactic. Despite these developments, the court’s decision means that John Peter Amewu will continue to serve as the MP for Hohoe.
