Dafeamekpor takes Controller and Accountant-General to court over parliamentary bid

In a recent development, Rockson-Nelson Dafeamekpor, the Member of Parliament for South Dayi, has initiated legal proceedings against Ghana’s Controller and Accountant-General, Kwasi Kwaning-Bosompem. The lawsuit aims to prevent Kwaning-Bosompem from participating in the New Patriotic Party’s (NPP) upcoming parliamentary primaries, where he seeks to become the party’s candidate for the Akim Swedru constituency in the 2024 elections.

The move comes as Ghanaians have intensified pressure on Kwaning-Bosompem in the past weeks, urging him to resign from his current position before contesting in the primaries. Following this, the South Dayi lawmaker, has now turned to the courts to address the issue, filing a writ that seeks to challenge the constitutionality of the Controller and Accountant-General holding onto his office while pursuing a parliamentary candidacy.

In the writ submitted, Dafeamekpor seeks a declaration from the court asserting that Kwaning-Bosompem, as a civil servant, cannot participate in the NPP’s parliamentary primaries while retaining his position as the Controller and Accountant-General. Furthermore, he contends that any civil servant aspiring to contest in a political party’s parliamentary primaries must first resign from their position.

The South Dayi lawmaker is also pursuing an interlocutory injunction to prevent Kwaning-Bosompem from presenting himself as the Controller and Accountant General while simultaneously maintaining his candidacy for the Akim Swedru parliamentary seat. The requested order aims to restrain the defendant from holding dual roles during the NPP’s parliamentary primaries scheduled for January 27, 2024.

In a related development, the Alliance for Social Equity and Public Accountability (ASEPA) Ghana has joined the fray, calling for the immediate removal of Kwasi Kwaning-Bosompem from office. The demand is based on allegations that the Controller and Accountant-General violated the Civil Service Act, PNDC Law 327.
