The Supreme Court has unanimously quashed the June 12, 2024, ruling by the Court of Appeal which ordered the reinstatement of Nii Adama Latse II as the Ga Mantse.
The apex court, led by Justice Gabriel Pwamang, held that the Court of Appeal’s decision violated King Tackie Teiko Tsuru II’s right to natural justice.
As a result, the Supreme Court’s verdict upholds the current recognition of King Tackie Teiko Tsuru II as the Ga Mantse.
The ruling followed a Certiorari application filed by lawyers of King Tackie Teiko Tsuru II, challenging the Court of Appeal’s directive. Lawyers for Nii Adama Latse II opposed the application.
The Court of Appeal had previously declared that Nii Adama Latse II’s removal from the national register of chiefs was unlawful due to the absence of proof of a valid destoolment process.
However, the Supreme Court’s decision nullifies that order and reaffirms the legal standing of King Tackie Teiko Tsuru II.
EIB Network’s Legal Affairs Correspondent, Murtala Inusah, reported that the Supreme Court also quashed an earlier High Court decision from Kumasi dated November 11, 2021, prior to ruling on the Court of Appeal’s order.
King Tackie Teiko Tsuru II was present in court with a large entourage. The panel included Justice Ernest Gaewu, Justice Richard Adjei Frimpong, Justice Gbiel Simon Suurbaareh, and Justice Philip Bright Mensah.
